Trademark Registration in Moldova (AGEPI)

A trademark registered at AGEPI gives you the exclusive right to use the name, logo or both for the goods and services listed in the certificate, across the Republic of Moldova. You can stop others from using an identical or confusingly similar sign, ask for counterfeit goods to be withdrawn and grant licences.

Without registration, protection depends on hard-to-gather evidence of earlier use. A company name registered with the Public Services Agency is not a trademark and does not automatically protect you against a competitor who files at AGEPI first.

Protection only covers the classes chosen at filing, out of the 45 classes of the Nice Classification (34 for goods and 11 for services). A café, for example, needs class 43 for food and drink services and, if it sells packaged coffee, class 30 as well.

AGEPI examination and renewal fees go up by EUR 50 for each class beyond the first, and the list cannot be broadened after filing. So we draft it carefully: wide enough for your business plans, without paying for classes you do not need.

The total cost has two parts: AGEPI official fees and the agent's fee. For an individual mark in one class, official fees are EUR 490: EUR 40 for filing and publication, EUR 200 for substantive examination and EUR 250 for registration and the certificate. Each extra class adds EUR 50 to examination, and collective and certification marks have higher fees. Our fee covers the search, drafting the application, correspondence with AGEPI and replies to any objections.

Before filing, you receive a written estimate with both parts, calculated for your classes. There are no hidden costs: if an opposition or objection needs extra work, we tell you first.

The fees and steps above follow Law No. 38/2008. The new Law No. 25/2024 on Trademarks enters into force on 2 April 2027, so for applications filed after that date we check the procedure and fees in force on the filing date.

A trademark is protected for 10 years from the filing date and can be renewed an unlimited number of times, each time for another 10 years. The renewal request is filed in the last 6 months of the term; after expiry there is a 6-month grace period with a surcharge.

The Republic of Moldova is a member of the Madrid System. Based on your AGEPI application or registration, you can file a single international application through AGEPI and designate the countries you need, for example the EU, Romania, Ukraine or the US. Each designated country then examines the mark under its own rules.

For the first 5 years, the international registration depends on the base mark in Moldova. That is why we start with a solid national registration and then plan the extension to the markets where you sell or plan to sell.

People and companies with no domicile, seat or real business establishment in Moldova can only act before AGEPI through an authorized agent. For those established in Moldova it is optional, but most refusals come from avoidable mistakes: a mark that is too descriptive, a badly drafted list of goods or a missed deadline.
