The standard AGEPI procedure usually takes about 12–18 months, provided there are no third-party oppositions or examiner objections.

The AGEPI application form, applicant identification, trademark representation, list of goods and services (Nice classes), and a power of attorney for the agent when applicable. For the standard procedure the power of attorney needs no notarization or apostille, and documents are filed in Romanian. Once we have everything, we usually prepare and file the application within 3–7 business days.

In Moldova, AGEPI trademark protection typically lasts 10 years and can be renewed. Lumis Consult tracks renewal deadlines so you do not lose protection.

An AGEPI trademark registration is valid for 10 years from the filing date and may be renewed for successive 10-year periods. The renewal request is generally filed during the last 6 months of validity; a further 6-month period after expiry is available subject to an additional fee.

Yes, a business name may be filed as a trademark with AGEPI if it meets the legal requirements and does not conflict with earlier rights. Registering a company name with the Public Services Agency does not replace trademark protection; the procedures and rights are distinct. We check availability and identify the relevant Nice classes before filing.

You may begin using the sign before registration, but filing an application does not guarantee acceptance or yet provide all the rights of a registered trademark. A prior search reduces the risk of infringing earlier rights or investing in a sign that may be refused. The ® symbol should be used only after registration.

Using a sign without registration is possible, but it generally does not give you the exclusive right conferred by a registered trademark in Moldova. If someone else has earlier rights, your use may lead to objections or disputes. AGEPI registration provides a clearer legal basis for protection and commercial use.

For national protection, the trademark application is filed with the State Agency on Intellectual Property (AGEPI), directly or through an authorized representative. Lumis Consult can conduct the prior search, prepare and file the application, and manage correspondence with AGEPI.

The process includes choosing the sign and goods or services, checking earlier rights, selecting the Nice classes, and filing an application with AGEPI. AGEPI formally checks and publishes the application and examines grounds for refusal, while third parties may oppose it within the statutory period. If the procedure concludes favorably and the fees are paid, the trademark is registered.
